CNMV Issues Warning to the Public on Unregistered Firms and Apps

The Comisión Nacional del Mercado de Valores (CNMV) has issued a public warning concerning several mobile applications and an entity that are not authorised to provide certain investment services or regulated crypto-asset activities in Spain.

Pursuant to the second paragraph of Article 18 of the Securities Markets and Investment Services Act (Law 6/2023, of 17 March), the CNMV warns the public about the following names:

• XEVATRON PRO APP
• GOUPHASE APP
• AIRFLOW APP
• BONDSPAN APP
• ADASON GLOBAL LIMITED

According to the CNMV notice, these mobile applications have been promoted through WhatsApp groups.

CNMV Regulatory Warning

The CNMV states that the above-mentioned entities and applications are not authorised to provide investment services and activities subject to the restrictions established under Article 129 of the Spanish Securities Markets and Investment Services Act.

The warning covers financial instruments detailed in Article 2 of the Act, including, where applicable, foreign currency transactions.

The CNMV further states that they are not authorised to carry out activities reserved for crypto-asset service providers, as described in Regulation (EU) 2023/1114 of 31 May 2023 on markets in crypto-assets, where prior regulatory authorisation is required.

Investors should exercise caution when dealing with financial services, trading applications, investment platforms, or crypto-related services promoted through messaging applications such as WhatsApp.
